A-ROSA
RIGHT OF WITHDRAWAL
Consumers have a fourteen-day
right of withdrawal when entering into a distance contract. A consumer is any natural person who enters into the contract for a purpose
that is predominantly neither commercial nor related to their self-employed professional
activity (Section 13 of the German Civil Code (BGB)). A distance contract exists when the
contract is concluded using exclusively means of distance communication—in particular
by mail, telephone, email, or fax—or via the Internet.
WITHDRAWAL NOTICE
The cancellation period is fourteen days from the day on which the buyer or a third party
designated by the buyer, who is not the carrier, has taken possession of
the gift certificates. If the contract covers multiple vouchers that the buyer
ordered as part of a single order and that are delivered separately,
the cancellation period is fourteen days from the day on which the buyer or a third party designated by the buyer —who is not the carrier—took possession of the last voucher.
To exercise the right of withdrawal, the buyer must notify
DSR Hotel Holding GmbH
Am Kaiserkai 69
D-20457 Hamburg
Tel.: +49 40 300 322-566
Email: gutschein@dsr-hotelholding.de
by means of a simple but unambiguous statement (e.g., a letter sent by mail,
fax, or email) regarding your decision to withdraw from this contract. For this purpose,
you may optionally use the attached sample withdrawal form.
To meet the withdrawal deadline, it is sufficient for the buyer to send the notification of
exercising the right of withdrawal before the withdrawal period expires.
CONSEQUENCES OF WITHDRAWAL
If the buyer withdraws from this contract, DSR must refund all payments received from the buyer,
including shipping costs (with the exception of any additional costs resulting from
the buyer’s choice of a delivery method other than the least expensive standard delivery
offered by DSR), within fourteen days from the date
on which DSR received notice of the cancellation of this contract.
For this refund, DSR will use the same payment method that the
buyer used for the original transaction, unless expressly agreed otherwise
with the buyer.
The buyer must return or hand over the purchased gift cards to DSR without delay and, in any case, no later than
fourteen days from the date on which the buyer notifies DSR of the cancellation of this contract
. The deadline is met if the
buyer ships the goods before the fourteen-day period expires. The buyer bears the
direct costs of the return shipment.
You are only liable for any loss in value of the goods if this
loss in value is attributable to handling of the goods that goes beyond what is necessary
to assess their nature, characteristics, and functionality.
